(Online Dating Industry Journal) Today the U.S. Supreme Court allowed a federal appeals court's ruling stand that indicated that the University of Texas did not violate the constitutional rights of online dating service owner White Buffalo Ventures after it blocked 59,000 e-mails associated with the singles service LonghornSingles.com in 2003.
An article by the Associated Press states:
"White Buffalo Ventures, which operates LonghornSingles.com, said it had complied with all anti-spam laws and argued that a federal act that allows certain e-mails superseded the university's anti-spam policy.
A 5th U.S. Circuit Court of Appeals panel ruled in August that the federal anti-spam law, CAN-SPAM, does not pre-empt the university's policy and that the policy is permissible under the First Amendment."
Although the email addresses were obtained legally by White Buffalo Ventures, the company refused to comply with a cease and desist order from UT, causing all email fromt he company to be blocked by the university.
